This year’s ASTC conference addresses the complexity of a rapidly changing legal environment, a society in transition, and the challenge of connecting legal disputes with social values. Our keynote speakers (George Lakoff on Friday and Shari Diamond on Saturday) are masters in understanding what jurors want when they take the oath to serve, and how to most effectively communicate with the core values and beliefs that guide them to their conclusions.

ASTC has served its membership for over 25 years with the goal of teaching, mentoring, and establishing professional standards that guide responsible practice. This year’s conference has an ambitious goal- to provide deeper understanding of complex and subtle aspects of various aspects of practice, and to feed the need to grow for those who are just starting in the field, and those who are masters.

Programs ranging from 60 minutes to 4-1/2 hours are offered to give attendees an opportunity to

Watch experts in trial graphics create and critique their own work

Watch masters in trial consulting in a long-format mock consultation, moving from theme development, jury selection, and case presentation

Understand the creative process related to identifying persuasive themes and integrating them into a dynamic visual trial

Understand recent developments in research, in practice innovations, and issues in controversy, and how they affectthe evolving practice of litigation consulting.

And of course, there is no better way to re-energize and learn than to be among your friends and colleagues in one of the greatest cities in the world. An enormous group of ASTC members have collaborated to bring you a program that promises to be fun as well as invigorating.

What happens when the media anoints a defendant a “celebrity” and spends vast amount of print space and on-air coverage on his hair style? How do you pick a “fair and impartial” jury when the pool has potentially seen thousands of articles and hours of airtime on the case, the Judge allows a live camera to broadcast the proceeding and publicly states that he wants to correct the public’s misconceptions of the justice system after the OJ Simpson case? Come hear tales of the strange and challenging Spector case: designing, reading and rating the questionnaire, selecting a counterintuitive panel, designing a fluid trial strategy, and dealing with a determined effort to unhang the jury.

Four defendants with four different agendas, eighteen shared strikes, what seemed like more lawyers than the entire jury pool, no coordinated plan and no cooperation. Selecting a jury in media mogul Conrad Black’s case was barely controlled chaos. The experience had much more in common with the frenzy of trading on the floor of the New York Stock exchange or being in a mosh pit of ecstasy crazed ex-federal prosecutors. In spite of the bedlam, the consultants (from two separate teams) still managed to influence the outcome through a combination of research, intuition, sarcasm, sharp elbos and a lot of shouting. If you’re interested in hearing more details of the Black trial you must be Canadian, a consultant or someone who has nothing better to do with their time. Whichever it is we’ll be discussing research insights, questionnaire design, voir dire process and selecting a jury that knew nothing about the case (easy) and who believed corporate excess was the right of every American capitalist even if they were a member of the British House of Lords (impossible).

Good recruiting is a central part of any successful mock trial or focus group. Recently, ASTC members have expressed interest in learning more about the “inside workings” of recruiting firms. To that end, these panel members have been “recruited” because they have recruited participants for a wide variety of qualitative research projects, including litigation research. We will talk about our perspectives on the “best practices” then have a collective discussion. Topics we will touch on include: How to get good recruiting done, RDD and database recruiting; small/rural versus urban venues; professional respondents, matrices and quotas.

The Rational Gatekeeper: Does Acknowledging Mock Jurors'
Emotional Reactions Lead to Cognitive Processing Changes?

When jurors are likely to have a negative visceral reaction to your side's client, should you advise your attorney to acknowledge the jurors' feelings or not? Previous research has shown that verdict disposition can be affected by manipulating mock jurors’ cognitive processing style. The current research to test whether counsel’s acknowledgment of mock jurors’ negative emotional reaction through a psychotherapeutic technique (empathetic mirroring) affects verdicts. Does engaging jurors’ emotions in this way make emotional information more salient? Does it lead to less biased, analytic processing? Find out!

Hating Corporate America: Measuring the Forms and
Effects of Anti-Corporate Juror Bias

As part of a collaborative project, Persuasion Strategies and Scientific Resources for the Law have combined their efforts, as well as five years of national survey data, in order to more closely assess the power of specific anti-corporate attitudes in predicting mock jurors’ disposition toward corporate defendants and other parties. This research project which is still in process will facilitate discussion on the subject of whether anti-corporate bias is necessarily fatal for corporations, or beneficial for individual litigants.

Paper of Remotes? A Test for the Effect of Audience
Response Systems on User Cognitive Processing.

Audience Response Systems (ARSs) in the form of "Clickers" and "Dials" are increasingly being used as a means of data collection in simulated trials and other litigation research. However, few studies have examined their effect on participant processing. Do they affect memory positively, negatively, or not at all? Do they distract jurors or serve to highlight information? In this presentation, we report initial findings from a study initiated by the ASTC Research Committee and designed to address these and related issues.

This session will review the efforts of the Professional Standards Committee in restoring and enhancing the ASTC Code, as well as the work undertaken to review and strengthen the Grievance Procedure. This year has had some tribulations in these areas and a discussion of what has been done to improve the ASTC in these areas is important to the ongoing refinement of the Code and our procedures.

Some of the changes to the ASTC code will require a vote at the conference. These modifications will be a part of the discussion during this session. And, as painful as these processes and developments may seem, the session will include an exploration of ways to make the Code come alive in a tangible form to provide a reference source for ASTC members. The committee is working to develop, as part of the ASTC website, a "Case Book" to archive members’ thoughts on a variety of ethical dilemmas.

George Lakoff, Ph.D. - Professor of Linguistics at the University of California, Berkeley and Senior Fellow of the Rockridge Institute, Berkeley, CA

George Lakoff is the co-founder and Senior Fellow of the Rockridge Institute. A Professor of Linguistics at the University of California, Berkeley, he previously taught at Harvard University and the University of Michigan. He has been a Fellow at the Center for Advanced Study in the Behavioral Sciences at Stanford, and a Visiting Professor at the Ecole des Hautes Etudes en Sciences Sociales, Paris (1995) and at the Linguistics Society of America Summer Institute at the University of New Mexico (Summer, 1995).

He has been a member of the Governing Board of the Cognitive Science Society (1989-1995), a Senior Fellow at the Townsend Center for the Humanities (1995-1996), and President of the International Cognitive Linguistics Association (1989-1993). He is currently on the Science Board of the Santa Fe Institute (1995-01) and is co-director with Jerome Feldman of the Neural Theory of Language Project at the International Computer Science Institute at Berkeley.

Dr. Lakoff has published a multitude of articles in major scholarly journals and edited volumes. He is the author of the influential book, Moral Politics: How Liberals and Conservatives Think, Second Edition, (2002). He is also the author of Women, Fire, and Dangerous Things: What Categories Reveal About The Mind (1987) and co-author of Metaphors We Live By (1980) [with Mark Johnson], More Than Cool Reason (1989) [with Mark Turner], Philosophy in the Flesh: The Embodied Mind and Its Challenge To The Western Tradition (1999) [with Mark Johnson], Where Mathematics Comes From: How the Embodied Mind Brings Mathematics Into Being (2000) [with Rafael Nunez]. His most recent books include Don't Think of an Elephant: Know Your Values, Frame the Debate (2004), Whose Freedom? (2006), and Thinking Points (2006) [with the Rockridge Institute].

In addition to his teaching and research commitments, Dr. Lakoff has been on the editorial board of Metaphor and Symbolic Activity, Journal of Pragmatics, Cognitive Linguistics, Philosophical Psychology, Connection Science, and the University of Chicago Press Cognitive Linguistics Book Series. He is regularly interviewed in the public media and has appeared on such radio shows as Talk of the Nation (with Ray Suarez), Bridges (with Larry Josephson), To the Best of Our Knowledge, and Forum (with Michael Krasny).

Juror bias takes many forms for many reasons. The social dynamic of being wary of those who are ethnically different has taken on a grave new meaning in the post-9/11 world. When citizens who are Muslim or of middle-eastern descent are parties to litigation or witnesses, the terrorism-weary jurors react. Strategies for uncovering the bias and dealing with it effectively will be the subject of this timely panel discussion.
